As I was setting up some showing appointments for one of my buyer clients, I was very excited that of the 4 short sales my buyer was considering, with a little research I found out that 3 of them were from lenders participating in the new HAFA program. This is great news as they are now covered by the new regulations to make short sales more uniform and hopefully, much shorter of a process!
One thing to note is that NOT all lenders are participating in HAFA, IT IS VOLUNTARY! If your loan is FHA, Fannie Mae or Freddie Mac, this new program does not apply to your loan. But there are still many alternatives to foreclosure, so please contact me if I can help you with some information and resources that could help you.
The up side is that many of the larger lenders ARE already paricipating, such as Bank of America, JP Morgan Chase, Wells Fargo, Citibank, Wachovia, GMAC....

Whenever you install new software or tweak any of your comport system files it's a pretty good idea to create a restore point! But because this takes a few minutes many users blow this chore off. Bad idea!
Just download this little gem and create a short cut. Then anytime you start messing with your system you can just click the shortcut and a short few seconds later your restore point has been created.

•· They have been on the market for an average of 243 days. Market time has decreased slightly in Cary.
•· The average list price is $325,559. The average list price for homes for sale in Cary has decreased.
•· During the past 3 months, 38 Single Family homes have successfully closed with the help of their Realtors. They took an average of 221 days on the market to be SOLD.
•· The average last list price of the SOLDSingle Family homes is $222,220 and the average SOLD price is $238,743. The average *first* list price of these homes was $281,850. By SHANNON MEHNER - editorial@nwherald.com Lights go out tonight for Earth Hour At 8:30 p.m. today, residents and businesses across McHenry County will switch off their lights for the third annual Earth Hour: 60 minutes of voluntary darkness to conserve energy and illuminate the issue of climate change.
McHenry County participants, along with the Illinois government, the Empire State Building, actor Edward Norton, basketball player Steve Nash, and millions of people and organizations around the globe, will shut off their lights at 8:30 p.m. in their respective time zones as a worldwide "call for action on climate change," ComEd Vice President Val Jensen said.
By shutting off lights around the world, individuals can come together to voice their concern about global warming and urge others to take notice, he said.
This year's event, which is sponsored by the World Wildlife Fund and ComEd, is supposed to be the "largest public demonstration in history," said Leslie Aun, the World Wildlife Fund's vice president for public relations and the managing director for Earth Hour U.S. 2010.
"How many Saturday nights do you get to make history?" she said.
More than 115 countries and 25 states officially are slated to participate, with 45 national monuments flipping the switch, including Chicago's Willis Tower.
But the event is really for "ordinary families and communities," Aun said.
Cary resident Debra Kukulski, a local Realtor, has powered down for the past three years and has been busy encouraging friends, family and clients to participate. During Earth Hour, she shuts off all of her electronics, invites her friends over, and uses candles for light, she said.
"I think it's just a really easy and fun way to show support that is not inconvenient in any way," she said.
Last year Kukulski and her guests kept the lights off longer than the designated hour because it was so fun, she said.
Other McHenry County participants this year include local government offices, businesses and schools.
Duke's Alehouse & Kitchen will be serving dinner by candlelight, and McHenry County Goddard Schools had environmental awareness activities all week, culminating in an Earth Hour celebration Friday that involved a flashlight talent show and a giant foam board light switch.
The events have made a big impact on the preschoolers' environmental awareness, said Michele Clark, owner of the Lake in the Hills Goddard School.
"The kids are telling on their parents," she said, adding that one came to school and tattled on her mom for throwing her gum out the window.
Earth Hour may be a "largely symbolic" call for action on climate change but can have a big effect on people's attitudes toward conservation and the environment, Jensen said.
"What we are really hoping will happen is people will take this opportunity to think about things they can do every other hour and every other day to have a positive impact," he said.

One important thing for home buyers to keep in mind is that since we are in such a strong buyer’s market now, there are many motivated sellers out there that have great homes priced to compete with the short sales, pre-foreclosures, foreclosures and REO’s and a buyer can usually purchase one of these homes with a less stress, money and risk factors than when buying a distressed property.

No Tax pro-ration: (usually 105% of the last tax bill in this area, banks only will usually give the buyer 100% of the last known tax bill)
Usually no negotiation on repairs, so if you do your inspection and it is not satisfactory to you, you talk with your attorney regarding canceling the contract if it is within the contingency dates, but no one will give you back the 300. or so you may have spend on a home inspection, or any fees that were paid to your lender. You may also be putting out your hard earned dollars for radon, lead paint, or mold inspections if you feel they are important to you.
Not closing on time can also cost you a Per Diem, as banks usually have this in their contract addendums. This is more of a risk now with underwriting and appraisals taking longer and daily changes in the banking industry. The addendums usually have a charge that the buyer will have to pay for each day after the original closing date if they can not close on time for any reason. I have seen this Per Diem charge being anywhere from 25-100 dollars per day.

Appliances: Banks usually say there is “no bill of sale on personal property”, so what you see when you write an offer may not be what you see before closing. Make sure you have some extra money put aside in case you have to purchase appliances.
Well/Septic Issues: If a property is on a private well or septic, you will also have to pay for your own inspections and this is usually a seller’s expense in this area. Another thing to keep in mind is that if you have an FHA loan, a vacant property that has a private septic system will not work since FHA now requires a copy of the septic test and if vacant, the inspector will usually put something on the report like “property is vacant and a re-test is recommended 30 days after normal use”. If the well test does not come back with the water being safe, the buyer will usually have to correct the situation since it is an “as is” contract.
De-Winterization and re-winterizing the property for inspections and final walk-through. In most cases this is a buyer’s expense. Even if you are not doing a home inspection, the appraiser usually will want the water on when they come by to do the appraisal, especially if it is an FHA mortgage.
No disclosures: Since they have never lived in or in most cases, have never even seen the property, they are exempt from having to do the usual disclosures. Your due diligence is even more important in foreclosures and any distressed sales.
Deferred maintenance: When someone can no longer pay their mortgage, many times they also have not been able to properly keep up with maintaining and updating their home so more repairs are usually necessary than on a home where the seller has been able to afford to keep up with updates and maintenance/repair issues.
Timing: Many times there is a very long wait to get a response on an offer, and it is usually worse with short sales than REO’s, which are properties that have already been foreclosed upon. You could be risking closing on time to be able to take advantage of the first time home buyers credit, which expires at the end of June 2010. Remember, you will have to have an accepted contract by the end of April 2010. I would recommend not waiting until the end of April to have a home under contract if you are a first time buyer or otherwise principal residence buyer who qualifies for the up to 6500. expanded home buyer tax credit. If that contract falls through so will your home buyer’s tax credit of up to 8000 or 6500!
Furthermore, in a short sale situation, in Northern Illinois the trend is becoming that once a seller signs a contract, contingent upon bank approval, the buyer usually needs to move forward with their inspections and mortgage approval right away, even though the bank has not yet made a decision if they will approve the short sale or not. Usually once the bank gives an approval, they do not give the buyer too long to close and most of the time it is not enough time to do this after approval. The other reason for this is that if a seller only sends one offer into the bank (which is usually how it is done because any time a new offer is presented to them they go back to square one and the waiting time starts all over!), the seller really does not want to risk that the buyer cancels the contract after they have waited so long for an answer and the clock is ticking for them when they are facing foreclosure so usually do not want to be tied up with a buyer who will not wait. In the Short Sales and Foreclosures Resource class I just took last week, the consensus seemed to be that buyers and sellers were waiting an average of 3-4 months for the bank to decide if they approve the short sale or not.
These are just some things to keep in mind when considering your options. Foreclosures and distressed sales can be excellent opportunities for the right buyer who is not trying to closely watch their costs, who has a lot of time and patience, who has some money to “gamble” with if contracts are not approved, who does not have to close by a certain date (like to get the first time buyer tax credit!) and the ability not to get too attached to or emotional about the property. Do not get me wrong, there are many great fantastic deals out there to be had right now, but do not make the mistake of thinking that the only good deals are distressed sales. Sometimes, a truly motivated seller with equity in their home can also offer a wonderful buy with less cost, less waiting and less hassles and a property in better condition as well!

Christmas Tree Farms in Northern Illinois and Eco Friendly Holiday Tips
As you do your holiday decorating this year, you may want to weigh out which kind of tree is more Eco-friendly. As an article published in my recent newsletter states, an artificial tree can be more earth friendly. Consider a potted plant which can be beautiful and can also be planted in spring. I personally like an artificial tree because I just do not feel right about cutting down a lovely, living tree that has flourished and grown only to use it inside as a decoration for a few weeks until it dies. I remember my Father having to pretend he "planted" a tree in the yard after Christmas one year when I was a kid, because I felt so sorry for the tree! I think that was the only year we had a real tree, but I know many people just love a real tree for the holidays. If you do purchase a fresh tree, please try to buy it from a tree farm so you are not damaging any forests. After you are through with your tree and the holiday season is over, please visit Earth911.com to find a Christmas tree recycling center. It is much better to recycle the tree into wood chips, which can have many uses instead of wasting that wonderful tree and letting it go to a landfill.
Another tip is to recycle instead of using expensive wrapping paper. Try to re-use your gift bags, bows and paper instead of throwing it in the trash. Creative and beautiful gift wrapping can be done with newspaper, old wallpaper scraps, bandannas, scarves, magazines, old posters, sheet music, coloring books, etc.!

$291,925
and the average SOLD price is $274,125.

This number is a bit skewed since there was only one attached home closed sale in the past three months in the quaint little town of Fox River Grove. Successful sellers, with the help of their Realtors, price their homes correctly for the current market.
None of the condo or townhome real estate homes for sale or closed sales in Fox River Grove in the past three months were short sales, pre-foreclosures, REOs and Foreclosures.
So, on the average, Attached homes in Fox River Grove have been getting an average of 87% of their *original* list prices, and 93% of their asking price at the time they received a buyer that closed, with the help of their Realtors, which is GOOD news!

The Tax Credit Has Been Extended and Expanded-NO LONGER FOR FIRST TIME BUYERS ONLY!
What the past first-time buyer credit did was significantly positively impact the entry-level end of the real estate market. By expanding it, we're going to see some move-up buyers take action since there is now an up to 6500. credit for qualified buyers that are not first time buyers, too.

•· During the past 3 months, 59 Single Family homes have successfully closed with the help of their Realtors. They took an average of 211 days on the market to be SOLD.
•· The average last list price of the SOLDSingle Family homes is $253,354 and the average SOLD price is $239,963. The average *first* list price of these homes was $292,756. Sellers who got more realistic in pricing had more success in getting to the closing table.
The average sale price in Cary has decreased since spring market, which is good news for buyers but not as positive of news for sellers!
With the help of their REALTORS, successful sellers in Cary have been getting
95% of their last asking prices and 82% of their original list prices!
